Confronted with the Supreme Court’s 2:1 decision recalling the ban on post-facto environmental clearances, the "new" Lady Justice appears to grope for a blindfold — to avoid watching a miscarriage of justice carried out in her name.

The Court’s ruling suggests that violations can be forgiven because money has already been spent committing them. That is not justice; it is capitulation. The Constitution never intended investment to outweigh injury, or convenience to outrank clean air and public health.
